CHILTERN CYCLES LTD TERMS AND CONDITIONS FOR OVERSEAS PARTS SOURCING
SERVICES These Terms and Conditions (the "Agreement") govern the services provided by Chiltern Cycles LTD ("the Business," "we," "us," or "our") to the customer ("the Customer," "you," or "your") regarding the sourcing, purchasing, and importing of motorcycle parts from third-party overseas suppliers on your behalf. By requesting Chiltern Cycles LTD to procure any motorcycle parts from an international supplier, you agree to be legally bound by these terms.
1. Scope of Service Chiltern Cycles LTD acts strictly as a facilitating agent to assist you in purchasing motorcycle parts from overseas third-party manufacturers, distributors, or suppliers. We do not manufacture, design, or stock these parts, nor do we act as an authorized distributor for the overseas suppliers unless expressly stated otherwise in writing.
2. Full Exclusion of Liability for Parts ● No Warranty or Guarantee: Chiltern Cycles LTD makes no representations, warranties, or guarantees of any kind, express or implied, regarding the parts sourced from overseas suppliers. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, quality, durability, or compatibility with your motorcycle.
● Supplier Faults: Any defects, manufacturing flaws, incorrect fitment, missing components, or premature failure of the parts are solely the responsibility of the third-party overseas supplier.
● Assumption of Risk: You assume all risks associated with the suitability, quality, and performance of the ordered parts. Chiltern Cycles LTD is not liable for any mechanical failures, property damage, personal injury, or financial loss resulting from the use or installation of parts sourced on your behalf. 3. Delivery, Shipping, and International Transit Risks
● No Delivery Liability: While we will make reasonable efforts to track and facilitate the shipment, Chiltern Cycles LTD accepts absolutely no responsibility or liability for transit delays, customs holds, border seizures, loss of items in transit, or damage incurred during international or local shipping.
● Shipping and Customs Costs: You are fully responsible for all costs associated with the order, including the base price of the parts, international freight, local delivery fees, insurance (if requested), and any applicable import duties, taxes, or customs clearance fees.
● Loss or Damage Claims: In the event that a shipment is lost, delayed, or damaged by the freight carrier or held by customs, any remedy or claim must be pursued directly with the carrier or supplier. Chiltern Cycles LTD will not issue refunds or replacements for logistics failures beyond our direct control.
4. Returns, Exchanges, and Disputes
● Final Sale Status: All overseas parts ordered on your behalf are considered non-refundable, final sales. Chiltern Cycles LTD will not accept returns, offer exchanges, or provide store credit for parts that do not meet your expectations, do not fit, or are defective.
● Supplier Liaison: If a part arrives defective or incorrect, we may, at our sole discretion, assist you in communicating with the overseas supplier to request a remedy. However, we do not guarantee a successful resolution, and any replacement or refund is entirely subject to the third-party supplier's policies and cooperation.
5. Installation and Mechanical Works If you request Chiltern Cycles LTD to install the sourced parts on your motorcycle, our labor and installation may be subject to separate service terms. However, our liability remains strictly limited to the execution of the labor itself; we remain completely exempt from liability for any underlying defects or failures inherent to the parts provided by the overseas supplier. 6. Indemnification You agree to indemnify, defend, and hold harmless Chiltern Cycles LTD, its directors, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, or expenses (including legal fees) arising out of or related to the procurement, shipping, delivery, or subsequent use of the overseas parts ordered on your behalf.
7. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Chiltern Cycles LTD operates. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the local courts. Customer Acknowledgment By signing below, paying a deposit, or instructing Chiltern Cycles LTD in writing to proceed with an overseas parts order, I acknowledge that I have read, understood, and agreed to be bound by these Terms and Conditions. I explicitly accept that Chiltern Cycles LTD bears no responsibility for delivery failures or the quality and performance of third-party overseas parts.
